Terms of Service
Last updated: 2026-09-18
1. Acceptance of Terms
Welcome to MuseHey (the “Platform”, “we”, “us”, or “our”). These Terms of Service (the “Terms”) are a legally binding agreement between you and the operator of the Platform and govern your access to and use of the MuseHey website, music-generation tools, account features, and related services (collectively, the “Services”).
By visiting the Platform, creating an account, submitting a generation request, purchasing Credits, downloading an output, or otherwise using the Services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Services.
Our Privacy Policy explains how personal information is handled. It forms part of this agreement for privacy matters. If a conflict exists, the document that specifically addresses the subject will control for that subject.
2. Definitions and Interpretation
In these Terms, the following words have the meanings below. Singular words include the plural where the context permits.
- “Platform”: the MuseHey website, its pages, APIs, storage interfaces, and related service endpoints operated for music creation.
- “Services”: tools that turn a user’s selections and text into songs or background music, together with generation history, playback, downloads, and related account features.
- “Creation Inputs”: prompts, stories, lyrics, moods, genres, instruments, vocal preferences, uploaded files, and other material submitted for a generation request.
- “Generated Output”: audio, lyrics, artwork, metadata, stems, or other material returned from a generation request.
- “Credits”: the usage units shown in your account and consumed by eligible generation or regeneration operations.
- “Regeneration”: an eligible additional generation for an existing successful initial work at the regeneration price displayed on the Platform.
- “Paid Services”: Credits, generation features, downloads, or other features that require payment.
3. Description of Services
MuseHey provides music-generation tools and technical processing services for songs and background music. The Platform is not a copyright agent, content distributor, or legal adviser. You choose a format, provide creative direction, and submit it for processing by the technology selected by the Platform.
- Music creation: the Platform provides song and background-music generation. Available scenes, styles, vocal options, and other creative directions are shown on the current Platform pages. Output length is determined by the generation result; the Platform does not currently offer separate duration tiers or duration selection.
- Generation history: completed and in-progress requests may appear in your account, subject to the history features shown on the Platform.
- Playback and download: when an output is ready and eligible, the Platform will show the available playback or download option.
- Service availability: generation time, quality, supported languages, and features depend on technical conditions and available capacity.
The Platform may improve, suspend, limit, or discontinue a feature. We will not deliberately remove Credits already paid for except where necessary to address fraud, abuse, legal requirements, or a material service change handled under the applicable refund rules.
4. Eligibility and Registration
You must be legally able to enter into a binding agreement in your place of residence. If you are under the age required to consent to online services, you may use the Platform only with the involvement and permission of a parent or legal guardian where required by law.
- Provide registration information that is accurate, current, and not misleading.
- Do not create accounts for other people without authorization or maintain multiple accounts to bypass service limits or obtain benefits you are not entitled to.
- If you register or use the Platform on behalf of an organization, you confirm that you have authority to bind that organization.
We may refuse registration or ask for verification when reasonably necessary to protect users, prevent fraud, or comply with law.
5. Account and Security
Some features require an account. You are responsible for keeping your sign-in method, recovery details, and device access secure and for all activity carried out through your account, except to the extent caused by our breach of these Terms.
- Use a strong, unique password where a password is used and do not share authentication codes.
- Notify us promptly through the available support channel if you suspect unauthorized access, a payment issue, or misuse of your account.
- Do not sell, transfer, rent, or commercially share an account or Credits unless we expressly authorize it.
We may temporarily restrict an account while investigating security incidents, payment disputes, abuse, or activity that could harm the Platform or other users.
6. User Content and License
You retain ownership of Creation Inputs that you lawfully own. You are responsible for making sure your prompts, lyrics, uploads, samples, recordings, artwork, and other submitted material may be used for the requested generation. When editing lyrics for a regeneration, you must confirm that the edited material is yours or that you have permission covering this use.
License to operate the Services
You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, format, transmit, process, and modify Creation Inputs as necessary to perform the requested feature, keep the Services secure, troubleshoot failures, handle support requests, and resolve disputes. This license ends when the material is deleted, except for limited copies retained for security, legal, backup, or dispute-resolution purposes.
Your responsibility
Do not submit material that infringes copyright, trademark, privacy, publicity, confidentiality, or other rights; contains unlawful instructions; or includes personal information that you are not authorized to disclose. Do not upload malware or files designed to interfere with the Platform.
Generated Output
Because AI systems can produce similar results for different users, we do not promise that any Generated Output is unique, original, or non-infringing. Generated Output does not automatically mean that you own complete copyright or commercial-use rights in it. Subject to applicable law, the Creation Inputs you own, the Platform's current rules, and the applicable rules of the external music service used for the request, you may use an output made for your account for lawful purposes. You must review an output and confirm that you have the necessary rights before publishing, monetizing, distributing, or using it in a sensitive context.
Public sharing
If you choose to publish or share an output through a Platform feature, you authorize us to display and deliver that output as needed for the sharing feature. You can manage or remove eligible items through your account where those controls are available.
7. Intellectual Property
The Platform, its software, visual design, names, logos, documentation, and original text are owned by or licensed to us and are protected by intellectual-property laws. These Terms grant you a limited right to use the Services; they do not transfer Platform ownership to you. Providing technical processing does not make the Platform your copyright agent, distributor, or guarantor of rights in your inputs or Generated Output.
- You may not copy, resell, frame, mirror, scrape, reverse engineer, decompile, or create a competing service from the Platform except where applicable law cannot restrict that activity.
- You may provide feedback, suggestions, or bug reports. We may use them without restriction or payment, provided we do not identify you publicly as the source without permission.
- External services, models, libraries, and related names remain subject to their own licenses, rules, and restrictions.
Rights in a particular Generated Output depend on the Creation Inputs, applicable external service terms, and local law. Nothing here grants rights that cannot legally be granted.
Copyright notices and complaints
If you believe content on the Platform infringes your copyright or another legal right, submit a notice through the contact channel shown on the Platform. Include your identity and basis for the right, the location of the material, your contact details, and a statement that the notice is truthful and accurate. We will review the report and may refuse generation, pause processing, restrict access, remove, or disable the relevant content as required by applicable law and our rules; where required, we may notify the relevant user and process a valid counter-notice.
8. Paid Services
Credits are purchased as one-time prepaid packages, not subscriptions. Paid features use the prices and Credit amounts shown at checkout or on the current pricing page. Before confirming a purchase, you can review the selected plan, price, currency, and applicable taxes or fees.
- Credits and generation: a generation or Regeneration uses the Credit amount shown for that operation. The required amount is displayed before you confirm the request.
- Technical failure: If generation fails because of MuseHey, our AI service provider, or another technical issue and no usable result is generated, you should not lose the Credits for that failed generation. Once the failure is confirmed, any Credits charged for it are automatically restored to your account. If the AI service provider has successfully generated the music but transferring or saving the audio file fails, MuseHey automatically retries the file transfer. This is not treated as a failed generation and does not trigger Credit restoration. Contact support if your music remains unavailable.
- Regeneration: a Regeneration is available only for an eligible successful work and can be used once. The price and availability window are shown before confirmation. You may create new lyrics and music, keep the current lyrics and remake only the music, or edit the lyrics and remake only the music; the latter two options do not generate new lyrics. When editing lyrics, you must confirm that the material is yours or legally authorized for this use.
- Payment processing: payments are handled by payment-processing services. We do not store complete payment-card numbers.
Refund requests must be submitted to [email protected] and are subject to review. All Credits from the order must remain unused, and your paid Credit balance must be sufficient to recover the whole package. Partial refunds are not supported. Eligible and approved refunds are subject to a service fee of 6% of the amount actually paid for the order, with the remainder normally returned to the original payment method and the associated Credits removed. Free and promotional Credits cannot be redeemed for cash. Approved refunds are generally processed within 5–10 business days after approval; bank or payment-account arrival times depend on your provider. Disliking an AI-generated result alone does not make used Credits refundable. See the Refund Policy for request details. These conditions do not limit mandatory consumer rights.
Except where required by law or expressly stated at checkout, a Credit purchase may be refunded only while none of the Credits from that purchase have been used. Once any of those Credits have been consumed for a generation, Regeneration, or another chargeable feature, the purchase is not refundable. A return of Credits after a confirmed technical failure is handled separately from a payment refund. Credits are not cash and are not transferable. Nothing in these Terms limits mandatory consumer cancellation, withdrawal, refund, or other statutory rights. Where applicable law requires consent to begin immediate delivery of a digital service and acknowledgement of any resulting loss of a withdrawal right, the checkout flow will present those choices before confirmation. If a payment is reversed or disputed, we may suspend the related account or remove the associated Credits while the matter is reviewed.
9. User Conduct
You must use the Services lawfully and respectfully. You may not use the Platform to infringe rights, evade safeguards, or place people or systems at risk.
- Generate or distribute content that is unlawful, fraudulent, defamatory, hateful, threatening, sexually exploitative, or intended to harass or impersonate another person.
- Submit copyrighted lyrics, recordings, samples, voices, or artwork without the rights or permissions needed for the intended use.
- Use automation to create accounts, bypass service limits, manipulate billing or Credits, probe external service endpoints, scrape private data, or bypass rate limits and access controls.
- Use Generated Output to train a competing model, identify a person without authorization, or make a high-impact decision about an individual.
- Upload malicious code, interfere with another user’s access, or attempt to discover source code, prompts, credentials, or private storage URLs.
10. Privacy Protection
Our Privacy Policy describes the personal information we collect and how we use, share, retain, and protect it when you use MuseHey. Privacy-related processing is governed by that Policy; where consent is required by law, we will ask for it separately before processing.
Do not include sensitive personal information in a prompt or upload unless it is necessary and you are authorized to provide it. Submitted content may be processed by the technical services needed to complete your request.
- We use access controls and signed links for private files where supported.
- We may retain security, billing, and audit records when needed to prevent abuse, resolve disputes, or satisfy legal obligations.
11. External Services and Links
Some features rely on external technology used for functions such as AI music generation, authentication, payment processing, cloud storage, hosting, analytics, and email or notification delivery. The relevant services may have their own terms and privacy policies.
- External service capacity, moderation rules, output formats, and availability may affect your request.
- A linked or integrated service does not mean we endorse its content or guarantee its availability, security, or continued operation.
- You are responsible for understanding the service rules, restrictions, and rights requirements that apply to a feature you choose to use.
We are not responsible for an external service’s independent acts or omissions, except where applicable law makes us responsible or an applicable agreement says otherwise.
12. Disclaimer of Warranties
The Services and Generated Output are provided on an “as available” and “as is” basis to the fullest extent permitted by law. AI generation is probabilistic and may produce inaccurate, unsuitable, repetitive, or unexpected results.
We do not promise that the Services will be uninterrupted, error-free, secure, compatible with every device, available in every location, or capable of producing a particular style, voice, lyric, duration, or commercial result.
- We do not guarantee that an output is original, non-infringing, factually correct, or suitable for a specific audience.
- You decide whether to publish, license, monetize, or rely on an output and should obtain professional advice for consequential uses.
- Mandatory consumer, statutory, or other non-waivable warranties remain unaffected.
Any examples, descriptions, or previews on the Platform are illustrative and do not create a promise about future features or a particular result.
13. Limitation of Liability
To the fullest extent permitted by law, we and our affiliates and personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, goodwill, data, or business opportunity arising from your use of the Services.
- your reliance on or publication of Generated Output;
- an interruption, delay, external service failure, or loss of access;
- unauthorized access caused by your failure to secure your account; or
- content, conduct, or services supplied by another user or other independent party.
Our total liability for claims arising from the Services will not exceed the amount you paid to us for the affected Services during the twelve months before the event giving rise to the claim, or the minimum amount required by applicable law if greater.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud or intentional misconduct where such exclusion is prohibited.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Platform and its affiliates and personnel from claims, losses, liabilities, costs, and reasonable expenses arising from:
- your Creation Inputs, Generated Output, or public use of either;
- your breach of these Terms or applicable law;
- your infringement or violation of another person’s rights; or
- your misuse of the Services or account.
We may take over the defense of a claim covered by this section. You will reasonably cooperate and will not settle a claim in a way that admits our fault or imposes obligations on us without our written consent.
15. Termination
By you
You may stop using the Services and request account deletion through available account controls or support channels. Closing an account does not automatically reverse completed purchases or erase records that we must retain.
By us
We may suspend or terminate access if you materially breach these Terms, create security or legal risk, abuse an offer, fail to resolve a payment issue, or if continued operation is no longer commercially or technically feasible.
Effect of termination
On termination, your right to use the Services ends. Sections concerning ownership, licenses needed for completed transactions, payment obligations, disclaimers, liability, indemnification, disputes, and general provisions survive as appropriate.
- We may preserve limited account, transaction, or security records for legal, accounting, fraud-prevention, backup, or dispute purposes.
- If we discontinue a paid feature, any remedy for unused Credits will follow applicable law and the notice or refund process offered for that change.
16. Dispute Resolution and Governing Law
Good-faith resolution
Before starting a formal proceeding, please contact us through the support channel shown on the Platform with a description of the issue and the outcome you seek. We will review the matter in good faith.
Applicable law
These Terms are governed by the mandatory laws that apply to your relationship with us. Any court or dispute forum will be determined by applicable law and any valid consumer protections; nothing here removes a right that cannot lawfully be waived.
Claims and time limits
A claim must be brought within the period required by applicable law. If a provision is unenforceable in one place, it will be adjusted only as much as necessary and the remaining provisions will continue.
Consumer rights
If you are a consumer, you may have additional statutory rights, remedies, or access to local dispute-resolution bodies. Those rights prevail where these Terms conflict with them.
17. Changes to Terms
We may update these Terms to reflect product changes, legal requirements, security needs, or clearer explanations. The updated version will be posted on the Platform with a revised date.
- For material changes, we will provide notice through a reasonable channel when required by law.
- Your continued use after the effective date means you accept the updated Terms.
- If you do not agree, stop using the affected Services and contact us about any applicable account or payment issue.
A change will not retroactively alter rights or obligations unless the law permits it or you expressly agree.
18. General Provisions and Contact
Entire agreement
These Terms, the Privacy Policy, and any feature-specific terms shown at checkout or in the relevant tool are the entire agreement about the Services and replace prior descriptions on the same subject.
Severability
If a provision is held invalid or unenforceable, it will be interpreted to achieve its lawful purpose as closely as possible, and the remaining provisions will remain effective.
No waiver
A delay or failure to enforce a provision is not a waiver of future enforcement.
Assignment
You may not assign these Terms without our written consent. We may assign them as part of a merger, reorganization, financing, or transfer of the relevant business, subject to applicable law.
Force majeure
We are not responsible for delay or failure caused by events beyond reasonable control, including outages, external service failures, network disruption, natural disasters, war, labor disputes, or legal restrictions.
Contact
For questions, complaints, account matters, or legal notices, please email [email protected] and include enough information for us to identify your account and the relevant request.
These Terms are written to describe the current MuseHey Services. Product pages and checkout screens may provide additional rules for a specific feature, and those rules apply to that feature when presented to you.
